Believe it or not someone has tried. And lost but Not because God is almighty. But because the court dismissed the case.

So what was the problem? In 2005, a man sued God for all sorts of intentional torts and atrocities against mankind – disease, pestilence – intentional flooding of the world (hmm…sounds like a great insurance claim #lawyerdream).

In any case, the problem was with service of process. A lawsuit can’t just be mailed to someone’s home like an Amazon delivery.

The law requires that a copy of the lawsuit be hand delivered … placed into the hands of the defendant and process server has to sign and affidavit that he did.

In another lawsuit filed against God…

Another guy got more creative and sued the church as an agent of God. This solved the problem of service of process because a church is an entity and can be served at the location of business. However, that lawsuit didn’t make it through the pearly gates either.

The court held, rightfully so, that an agent cannot stand in the place of the named defendant.

So there you have it. You can sue God but first you have to find him. And if you do, let me know if he needs a lawyer. I wonder what kind of retainer I could get.
